Carrie Kiefer, et. al. v. Hiram Hyatt, et. al. lawsuit, Daviess Circuit Court, January Term, 1895. Action to partition large tracts of real estate in Daviess County, Indiana formerly owned by Elisha Hyatt who died December 31, 1885. Before he passed away, Mr. Hyatt on December 12, 1884 made an assignment for benefit of creditors as an insolvent debtor and William Hyatt and Hugh Rogers were appointed Trustees of his property. Hugh Rogers declined to serve and Hugh Barr was appointed as his successor by the Daviess Circuit Court. The plaintiffs claim that owing to "depression in the price of farming products" the Trustees cannot earn sufficient income on the land to pay debts. The plaintiffs request that the real estate be partitioned and sold. |
