Charles Auberry v. Fred L. Scoble lawsuit, Daviess Circuit Court, Cause No. 8583, October Term, 1894. Defendant operated a grocery business and plaintiff acknowledged he owed $23.23 to defendant for groceries purchased on credit. Plaintiff was employed by the Baltimore & Ohio Southwestern Railroad. Plaintiff claimed defendant retained the Equitable Collection Company in Louisville, Kentucky to collect the $23.23 debt. The collection company filed suit against Mr. Auberry in a Justice of the Peace court in Jefferson County, Kentucky, obtained a $45 judgment against him, garnished his wages from the B & O Railroad, and transferred the garnished wages to defendant. Plaintiff claimed his wages were exempt from attachment and that he lost his job with the railroad because of the garnishment. He requested damages of $500. |
