Agnes J. Green v. The Ohio & Mississippi Railway Company lawsuit, Daviess Circuit Court, Cause No. 7668, January Term, 1891. Agnes J. Green claimed on October 16, 1891 she traveled as a passenger with her two children, aged about 2 and 4 years, on a train operated by the Ohio & Mississippi Railway Company from Loogootee, Indiana to Cannelsburg, Indiana in Daviess County. When the train arrived at Cannelsburg, according to Ms. Green, it stopped short of the Cannelsburg depot. She and her children remained in the train thinking it would pull up to the depot. The train traveled about a mile past the depot before it stopped. Mrs. Green, who said she was in delicate health, and her children were forced to walk the mile back to the Cannelsburg depot with Mrs. Green carrying the youngest child. Because of the mile walk, Mrs. Green claimed her health was "greatly impaired", rendered sick and confined to her bed for "a long period of time." She asked for damages of $2,000. A jury trial was held and returned a verdict for Mrs. Green and against the railroad for $125. |
