Daviess County Circuit Court file, Cause No. 7904, October Term, 1892, Noah Cook & Frederick M. Myers v. Alfred Ellis, Samuel P. Ellis, William P. Ellis, Indiana Gaither & James Gaither lawsuit to collect commission on sale of real estate. Mr. Cook and Mr. Myers claimed that in July 1891 the defendants were owners of about 100 acres in Daviess County and the defendants "requested and employed" plaintiffs to sell the real estate and agreed to pay a 4% commission if the real estate was sold. Plaintiffs claimed that during their employment the defendants in October 1891 began negotiating with Elijah Gowdy to sell the real estate which they sold to Mr. Gowdy on January 13, 1892 for $6,000. Mr. Cook & Mr. Myers claimed the defendants refused to pay the agreed commission of $240. Judgment was entered on behalf of Mr. Cook & Mr. Myers on November 5, 1892 for $243.42. Judgment was paid on December 22, 1892 by Samuel P. Ellis to Alex Odell, Deputy Sheriff of Daviess County. |
